"In-kind" is the key phrase. On a chimney it usually means:

  • replacement brick that matches the size, color and texture of the original;
  • mortar that matches the color, hardness and joint profile of the old joints;
  • a crown rebuilt to the same shape and overhang;
  • flashing replaced in a similar material and layout.

Work that departs from these, such as a full rebuild in a different brick, a taller or shorter stack, or covering brick with stucco, moves toward "alteration or replacement." If you are in the district, check with the borough before that kind of job.
